In a bizarre incident of shielding corruption and not initiating disciplinary action against  prima face guilty senior forest officers of Maharashtra cadre as per provisions of GR no. GAD 1608/CR 47/08/11A dated 1-11-2008 , the office of the Head of the Forest force, Maharashtra state , Nagpur has admitted knowing the stories of corruptions with hard evidences against forest officers, but refused to initiate the action. According to them, question does not arise for any action even if they are neck deep involved in corruption.

On a requisition under RTI Act 2005 by one Dr Raghuvanshi, PIO of PCCF office, Nagpur has informed to Dr Raghuvanshi vide his letter dated 26-4-2011 that PCCF office is aware of stories with evidences being published on www.corruptioninmaharashtra.com against senior IFS officers of Maharashtra cadre, but he refused to give the information stories-wise on the pretext that the said information is available with different desks in the same office of PCCF.  It is very surprising that though as per section 6 (3) of the RTI Act, 2005,  PIO is mandated and duty bound to send the portion of requisition of information to the other relevant PIO and he can not deny information on the ground that one should send separate requisition letters to different PIOs in the same office.

Rule 6 (3) of PIO reads as follows:

6 (1) A person, who desires to obtain any information under this Act, shall make a request in writing or through electronic means in English or Hindi or in the official language of the area in which the application is being made, accompanying such fee as may be prescribed, to—
(a) the Central Public Information Officer or State Public Information Officer, as the case may be, of the concerned public authority;
(b) the Central Assistant Public Information Officer or State Assistant Public Information Officer, as the case may be, 

specifying the particulars of the information sought by him or her:

Provided that where such request cannot be made in writing, the Central Public Information Officer or State Public Information Officer, as the case may be, shall render all reasonable assistance to the person making the request orally to reduce the same in writing.

(2) An applicant making request for information shall not be required to give any reason for requesting the information or any other personal details except those that may be necessary for contacting him.
(3) Where an application is made to a public authority requesting for an information,—
(i) which is held by another public authority; or
(ii) the subject matter of which is more closely connected with the functions of another public authority,the public authority, to which such application is made, shall transfer the application or such part of it as may be appropriate to that other public authority and inform the applicant immediately about such transfer:  

Provided that the transfer of an application pursuant to this sub-section shall be made as soon as practicable but in no case later than five days from the date of receipt of the application

REASONS FOR NOT SUPPLYING THESE INFORMATION BY HOFF:::

Through reliable sources we came to know that HOFF MS has not provided these information against senior IFS officers of Forest department since almost all of them were due for promotions. It is really courageous  of the PIO and office of the PCCF that to shield officers they have defied the LAW and provisions of the departmental inquiry against officers  as per provisions of said GR.

ACTION REQUIRED IN THE MATTER::

  1. The guilty PIO should immediately be punished for not following the dictate of law, as provided in the GR.
  2. The HOFF office , who says that there is no question of initiating any inquiry against corrupt officers should apply its mind again to avoid serious embarrassment in future.

    It is really shocking that office of the PCCF is behaving in such blatant manner. This is reflection of PCCF’s administrative capabilities. What is the problem in giving information ? It looks there is new group emerging in office of PCCF.

    • You are soooo rigghhtt! And it is headed by an ex PCCF who continues to wage a proxy war on his perceived adversaries through his chosen set of cronies! That group is resurging to take control of Van Bhavan. Scrape through the surface and the rot will become apparant! the Don has shifted his headquarters to the plinth level of Richie Rich edifices. The Hindi Sider is out on the prawl! Beware sons of the soil! And yes! Who cares about forestry anyways?

  4. This does not seem to be a deliberate mistake. It looks that PIO does not know the provisions of act very well. How otherwise it would have interfered with promotions.

    Sir, had this information been given to Dr Raghuvanshi, which in any case HOFF has to give either smoothly or by coercive law, this story would have been avoided. We are worried till when this raid on IFS of Maharashtra would continue in future. More than 30000 hits are there on this website. Can we be little more sensible in understanding it ?
    Sir, can we be not objective in our behaviour instead of subjective and take law in our hand just to help a few black sheep. .

  6. I can bet if more than 2% IFS officers are aware of provisions of RTI Act. They are only expert in RFO syndrome i.e. cheque issue and purchases of seeds and fertilisers.

    Dear freinds, it is absolutely right that both present JS in R&FD are absolutely of no good use. They are self centered persons and with cow dung in their head. As we all know that there are several complaints by IFS officers of Maharashtra cadre against them. They are not clearing files of leave, release of increments, cadre management, LTC, medical reimbursement, promotion orders , DPC process and so on. They forget that they too have to come back to department. Rest assured persons like me are waiting for them to come back to department. I also have worked in the similar position without any expressed complaint. Additional Chief Secretary is a dead wood waiting to retire. She does not trust anyone except these two JS because she herself does not read the file nor does she apply her mind anywhere. We know caliber and nature of HOFF. Hence I suggest you all to personally go to F-7 pay 5000/- there and get your filed prepared and then get it cleared from JS.

    from last 4 years ,i am asking information of permanant record destroyed by bogus recruited babus but the senior officers are not taking action against them. because these babus destroyed their charge-sheets and criminal records from p.c.c.f. office and F-7 desk. i applied to squzee these people but ……

    We blame Minister for the thriving transfers and posting industry. However this year except for the 10 percent transfers where the people of Minister were interested proposals submitted by HOFF were through. There you see the blatant favouritism and coterie syndrome in the proposals submitted by the HOFF. Why blame politicians when we ourselves are not fair to our own people? The same HOFF when sits in an association meeting shows helplessness against politicians and blames them left and right for the chaos prevailing in the department but when he prepares the proposals for the transfers he chooses plum postings for his near and dear ones . Are these not double standards? Why then people shouldnt approach minister and get their job done?

    Pccf office is dieing, Mantralaya is diseased,Do not hope any things from administration of this Department. Pccf office is full of BABUS (ccf/apccf/pccf) who do not understand the demand of the soil.Within coming 10 years at the most 5% area of reserved forest may remain under cover. Do not expect any information from PCCF office. these babus(with more than 70000 salary) only ask the information from subordinate office.They do not use their Heads.(since they do not have it)
